Website Terms and Conditions

Effective date November 6, 2026

Scope and agreement

These Website Terms govern access to the public marketing website, event landing pages, public content, and demonstration experiences provided by Dealership Servicing AI, Inc., doing business as EvenFlow AI (EvenFlow, we, us, or our). They do not replace a signed order form, subscription agreement, data processing agreement, or other agreement governing a paid product. That separate agreement controls its subject matter if there is a conflict.

Where we ask you to accept these Terms, accept only if you agree and have authority to act for the business you identify. If you do not agree, do not use a feature requiring acceptance. Whether other conduct forms an agreement depends on applicable law and the notice and assent actually provided. The Privacy Policy explains information handling; it is not blanket consent to optional marketing or a waiver of statutory rights.

Permitted website use

We authorize lawful use of the website to learn about EvenFlow, read public content, evaluate our services, and contact us. You must have legal capacity to enter an agreement when using a feature that requires one. You are responsible for the accuracy of information you submit and for obtaining permission before providing someone else’s information.

Do not misuse forms or systems; send spam or malicious code; impersonate a person; attempt unauthorized access; bypass access or security controls; harvest personal information; interfere with availability; or use the site unlawfully. Do not probe or test nonpublic systems without authorization. Report suspected issues through our designated support channel rather than exploiting them.

Ordinary public search and answer-engine indexing and linking may operate consistently with applicable law, copyright, and published access rules. This does not authorize bulk extraction of contact details, access to private APIs, circumvention, or copying restricted material.

Ownership and limited permission

The website’s software, design, branding, text, and other protected material belong to EvenFlow or its licensors. Third-party names and marks belong to their respective owners. You may view content and make reasonable internal copies for evaluating EvenFlow, keeping ownership notices intact. No ownership or other license is transferred except as expressly stated or required by law.

Do not redistribute protected material commercially, remove rights notices, present our content as your own, or use our marks in a way that implies an unauthorized affiliation. Lawful quotation, fair use, and other mandatory exceptions are not restricted. A partner logo or reference does not itself promise an identical integration, certification, endorsement, or feature for every dealership.

Inquiries and submitted material

An inquiry, demo request, discussion, or general website statement does not create a subscription, service commitment, confidentiality agreement, or promise to contract. An authorized written agreement is required for a binding purchase or service commitment.

Submit only material you are entitled to provide. You give us permission to process submitted information to operate the requested feature, respond, and administer the relationship as described in the Privacy Policy. We do not obtain ownership of your personal information. Do not send trade secrets or confidential customer information through general forms; arrange an appropriate agreement and channel first. Nonconfidential product suggestions may be considered and used without a duty to pay, subject to applicable law and any separate agreement.

Demonstrations and dealership decisions

Public demos, sample booking experiences, articles, videos, and illustrative outputs are provided for evaluation and information. They may differ from a configured or contracted product. Do not enter real customer data or make an operational service booking in a sample environment unless that use is expressly authorized.

A sales demonstration request is not a dealership service appointment. In an operational booking experience, the dealership’s actual availability, policies, and confirmation process govern the appointment. Website availability or a preview alone does not promise parts availability, transportation, a repair completion time, or acceptance of a particular service request.

Dealerships remain responsible for their staffing, customer communications, data quality, business decisions, and compliance obligations except to the extent an executed agreement expressly assigns a responsibility to EvenFlow. Scheduling recommendations and automated or AI-assisted information require appropriate human review. Do not rely on website content as legal, financial, safety, or other professional advice.

Statements about capabilities and results

Features, integrations, compatibility, implementation scope, and commercial terms depend on the applicable configuration and written agreement. Public content may change or contain errors. Confirm material requirements with our team before making a purchasing or operational decision. Quotes are subject to their stated scope, validity, and acceptance terms.

Testimonials and examples describe particular experiences, not a guarantee of future or typical results. Outcomes depend on factors such as dealership operations, demand, capacity, configuration, inputs, and consistent use. No specific increase in revenue, gross, productivity, utilization, search visibility, or other outcome is promised through the website. These statements do not excuse misleading claims or limit obligations imposed by law or a separate agreement.

Third party services

The website may embed or link to services and content operated by others, including video, social media, booking, news, or digital-assistant services. Their availability, conduct, outputs, privacy practices, and terms are their responsibility. We do not guarantee their content or availability, and linking does not necessarily mean endorsement. Your use may require a separate agreement with the provider.

The website uses YouTube API Services and embedded videos. By using the website’s YouTube features, you agree to be bound by the YouTube Terms of Service at https://www.youtube.com/t/terms. Google’s Privacy Policy is available at https://policies.google.com/privacy. Our permission to display third-party content does not grant you broader rights to reuse it.

Availability and changes

We may update, suspend, limit, or discontinue website content or features, or restrict access reasonably to address misuse, security, maintenance, or legal requirements. We do not promise uninterrupted availability or preservation of an unsent form. This website provision does not override a separately contracted service level, support commitment, data obligation, or remedy.

We may revise these Terms prospectively by publishing an updated version and effective date. Material changes requiring notice or renewed assent will be handled accordingly. A revision does not retroactively change an accrued claim or a separate agreement merely because it appears on the website.

Warranty disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PUBLIC WEBSITE AND ITS INFORMATION AND DEMONSTRATIONS ARE PROVIDED AS IS AND AS AVAILABLE. EVENFLOW DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT, AND DOES NOT WARRANT THAT THE WEBSITE WILL BE ERROR FREE, SECURE, COMPLETE, CURRENT, OR UNINTERRUPTED.

No general website statement expands a warranty or service commitment beyond an applicable executed agreement. This disclaimer does not exclude an express obligation in that agreement, a mandatory statutory warranty, or another protection that applicable law does not allow to be disclaimed.

Limitation of website liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVENFLOW AND ITS PERSONNEL, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE UNDER THESE WEBSITE TERMS FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, OR DATA, ARISING FROM THE PUBLIC WEBSITE, EVEN IF ADVISED OF THEIR POSSIBILITY.

For claims governed solely by these Website Terms, the aggregate liability of those parties will not exceed the greater of US $100 or the amount you paid EvenFlow specifically for access to the public website during the 12 months before the event giving rise to the claim. Fees and liability for subscribed products are governed by their separate agreement, not this website cap.

These exclusions and limits apply only where lawful. They do not limit liability for fraud, willful misconduct, gross negligence, or other liability to the extent it cannot lawfully be excluded or limited. Nothing waives nonwaivable consumer, privacy, data-protection, or other statutory rights. If a limitation is unenforceable, it applies only to the maximum extent the law permits.

Business indemnity

If you use the website for a business, then, to the extent permitted by law, that business will defend and indemnify EvenFlow against third-party claims and reasonable resulting costs to the extent caused by its unlawful misuse of the website, infringement through material it submits, or material breach of these Terms. This does not cover claims caused by EvenFlow’s own breach, negligence, or misconduct. We will provide reasonably prompt notice and cooperation, permit reasonable control of the defense, and not agree to a settlement imposing an admission or nonmonetary obligation on an indemnified party without its consent.

Disputes and general provisions

Subject to mandatory applicable law, these Website Terms are governed by the laws of the State of Illinois, without applying conflict-of-law rules. Courts with jurisdiction in Cook County, Illinois will hear disputes governed by these Terms, except where mandatory law requires another forum or permits a claim elsewhere. A voluntary effort to resolve a dispute through our contact channel does not limit statutory deadlines or access to available legal remedies.

Neither party waives a right by delay alone. If a provision is invalid, the remaining provisions continue to the extent lawful. These Terms address the public website only and create no partnership, agency, or third-party beneficiary rights unless expressly stated. Provisions intended to survive continue after access ends, subject to applicable law.
